Conditions renting  Apartment S

Apartment S

Apartment S is located in the basement of our house and only accessible via stairs (not barrier free). The Apartment has an own, separate entrance. The living space is kept open. A terrasse is attached to the Apartment S.  The terrasse will be used occationally by the landlord for gardening purposes as a  passageway.

 

Validity of the General Terms and Conditions

These general terms and conditions apply to the rental of the holiday apartment for accommodation.The tenant agrees to these general terms and conditions. The declaration of consent takes place with the payment.

Equipment

The Apartment S has a bathroom with Shower and toilet, an open kitchen with dishes, a oven with ceran hobs, fridge, pillows, bed linen, towels and dishclothes. WLAN and HDTV TV (Satellite). A passenger car parking bay is provided.

 

Conditions / Maximum occupation

The rental confirmation is usually done by email. The contract is binding for both partners and closed on behalf of this terms. The Apartment S may only be used by the number of persons named in the contract (max. 2 persons). Minimum duration of the stay is 3 nights. 

 

Use

The tenant must treat the apartment with care. The inventory is intended exclusively for remaining in the holiday apartment. Subletting or reletting for purposes other than residential purposes is not permitted. The apartment may only be used as a living space. Any kind of commercial or even immoral use (prostitution, etc.) is strictly prohibited. If this is not adhered to, we reserve the right to vacate the apartment immediately. The rent paid will not be refunded.

Pets

Sorry, we do not accept animals.

 

Smoking policy

We kindly ask our guests to accept our strictly non smoking policy within the apartment.

Cleaning

The Apartment S has to be maintained by the guest during the stay. We  do not offer roomservice. A final cleaning is mandatory and will be charged. Cleaning kitchen machines and dishes is not included in the final cleaning. If you ask for a special treatment please contact us.

Terms of payment

A downpayment of 25% of the total amount is due on booking.

The rest is due 6 weeks prior to check-in. If the payment is not done according to the contract the landlord can rescind from the contract.

Liability for damages

The lessee is personally liable for all items in the Apartment and is obligated to compensate in full if anything is broken. 

In case of damage the lessee informs the landlord immediately. Damages that have not been indicated will be repaired on the lessee´s expense. Damages, that occur during the stay will be fixed promptly (subject to appropriate delivery time).

The landlord bears no responsibilty for any loss of valuables, property of the lessee , from the accommodation unit.

 

Rescind

In case of a rescind by the lessee the following rules apply:

  1. More than 6 weeks prior to the check-in the total amount of the downpayment is retained.

  2. For short time cancellations within less than 6 weeks prior to check-in we charge 80% of the total amount of the rental price.

  3. Less than 2 weeks the full amount of the rental price is due. 

 

Objections

Should the lessee, contrary to expectations having any issues with the rented facility, he shall promptly, within 48 hours, indicate these towards the landlord. Otherwise the lessee is fully liable for any damages.

 

Force Majeure

The rental agreement may be terminated without notice by the landlord due to the occurrence of force majeure or other circumstances that are beyond the landlord's sphere of influence, if force majeure or other circumstances for which the landlord is not responsible make fulfillment of the contract impossible, or if the the holiday apartment was booked with misleading or false information about essential facts, for example the identity of the tenant or the occupancy or the accommodation of animals, and/or the holiday apartment is used for purposes other than residential purposes.

 

Disputes 

any interpretation of the rental contract is in the obligation of a legal court in Loerrach, Germany. The rental contract is based on german law. If there is any difference between the english version and the AGBs (german language) the conditions as written in the German AGBs apply.
